ENERGY CERTIFICATES…(SELLERS) There has been various stories of the last few months and like most new legislation’s brought into effect the level of transparency has been somewhat tainted.
We have spoken with our local notary and various lawyers and the feedback we have is the following:
As of the 1st of June 2013 – As a homeowner in Spain, if you are looking at renting or selling your property you must possess an energy certificate. In exceptional circumstances the notary can sign over the house as normal but it has to be documented in the new title deeds that the buyer accepts the fact that no certificate is in place and they take on the responsibility. Given that this will be in the minority of cases and that a certificate will be required when marketing a property for sale we are advising all vendors to take the necessary steps in obtaining a certificate. The certificates will be valid for 10 years.
